NPC monsters have a set % of crit that they never go over and it is based on the level of the creature vs. the def level of you character. I think the amount of a raid boss is something like 15% chance to crit if I am not mistaken. Players on the other hand can easily have more than 30% crit. So you can see why dueling you would be able to get some crits through... PVP combat is different from PVE. Duels are different than PVE combat.
